Rentals

 The Borough Council of the Borough of Mount Penn has determined that for the benefit of the public health, safety, and welfare it is necessary to establish two ordinances, The two ordinances are the ORDIN 863 TENANT REGISTRATION  and the ORDIN 865 CRIME FREE RESIDENTIAL RENTAL HOUSING PROGRAM Both ordinances are attached below. In the Tenant Registration Ordinance any rental property that is rented for over 30 days, the owner, landlord or agent must provide to the Borough Secretary a Tenant Listing (PDF Fillable form is attached below), which lists all tenants and occupants that will occupy the residence, address of residence, and all contact information including email.

The Borough of Mount Penn has also established Ordinance 865 Crime Free Residential Rental Housing Program (Ordinance 865 is attached below).  The ADDENDUM TO ORDINANCE 865 TO CRIME FREE RENTAL HOUSING PROGRAM is also listed below.  The Search Waiver Consent form is also required to be filled out.

Every year by January 31 a rental operating license is required. The Application for Rental Unit Registration & License (PDF fillable form is attached below), is the application that needs to be submitted to the Borough with a check made out to the Borough of Mount Penn for the fee amount listed below:

Enforcement Action

$95.00 per unit (1-5 units at a single address or complex)

$85.00 per unit for 6 or more units at a single address or complex

$150.00 per unit- no reduction for multiple units

$150.00 per unit caused by a failure to comply with the ordinance: — no reduction for multiple units. Failure to correct inspection failures within 10 days.

 

A New Rental Unit Annual Registration $75.00 after March 31, of any successive year.

Biennual Inspection fee included in the Annual License. Rental property inspections are held once every two years, unless there is a change in tenancy.

Re-inspection fee caused by a failure in the Bi-Annual Inspection $50.00

Re-inspection Fee caused by two required re- inspections: $100.00

Change in tenancy inspection: $75.00 (With a change in tenancy the bi-annual inspection date changes to the new occupancy date.)

Failure to register new Tenants prior to occupancy: $150.00.

 

RENTAL PROPERTY INSPECTION

Inspections will be done on a bi-annual basis. The inspection of the property is to determine compliance with minimum standards and requirements as follows:

  • Each dwelling unit must have a smoke detector installed on each floor level and in the bedroom areas.
  • An existing acceptable 60 ampere service, or a minimum 100 ampere three (3) wire electric service must be installed for the dwelling.
  • All sidewalks and curbs must be in good repair free of large cracks and crevices, missing bricks and tripping hazards.
  • All properties must be supplied with numbers outside the property, in clear view of the street, designating the street number of the property.
  • The property and structure must be in compliance with all other aspects of the International Property Maintenance Code adopted by the Borough.

ALL NEW REGISTRATIONS ARE FOR THE FIRST TIME THE UNIT WILL BE USED AS A RENTAL. In these cases, the code enforcement officer will schedule an inspection within 15 days of receipt of a valid application and payment for an operating license. At the initial registration they must also provide a tenant listing, application, and lease with crime free addendum.
